Welcome to the section where we explain the terms that apply to your purchases when you use our services! Our goal is to make your shopping experience easy, efficient, safe and clear. It is important that you read these terms carefully and agree to them before completing the purchase.

By using our site to purchase tickets or access events, you are agreeing to the Terms and Conditions below. The Terms and Conditions may be updated from time to time.

Ticketera provides ticket processing, marketing, box office management services and Ticketera®® LIVE provides "On Demand" or "Pay Per View" live streaming service of third-party presentations and concerts through the www.ticketera.com and live.ticketera.com platforms, both operated by TiX.By LLC for purchases made in Puerto Rico. Purchases made in the United States, excluding Puerto Rico, are operated by TiX.By USA LLC (collectively "TiX.By"). TiX.By is a leading provider of transaction processing services and financial applications and owns the Ticketera® brand.

The terms and conditions of use of the Ticketera® service are as follows. By using the Ticketera® service, you agree to comply with these Terms and Conditions.

  1. Changes to Terms and Conditions

TiX.By reserves the right to change or discontinue at any time any feature or aspect of the Ticketera® service including, without constituting an exhaustive or exhaustive list, content, hours of availability and equipment necessary to access its use.

TiX.By reserves the right to change or modify at any time the terms and conditions applicable to the use of the Ticketera® service or any of its parts, or to impose new conditions, such as additional or modified fees and charges. Any change, modification or deletion will be effective immediately whether notified through the http://www.ticketera.com portal or by any appropriate means of notification. Any use of the Ticketera® service that is subsequent to such notification will constitute acceptance of such changes, modifications, additions or deletions.

  1. User Conduct

You may use the services of Ticketera® for lawful purposes only. Any conduct that TiX.By considers that potentially generates civil liability or that violates any law, or that in any other way restricts or prevents the use and enjoyment of the Ticketera® service by any other user is prohibited.

Ticketera® reserves the right to refuse service to anyone for any reason at any time. This includes the right to terminate accounts and invalidate transactions for violations of our policies and terms and conditions. The use of automated systems or software to extract data from this website ('screen scraping' or 'data collection') is prohibited. In addition, the use of "bots", automated methods or other non-human means to access, purchase tickets or manipulate the services, accounts or systems on this website to buy tickets, including but not limited to systems and / or methods that allow to purchase tickets in excess of the maximum amounts imposed by Ticketera® for users, is strictly prohibited.

Ticketera® reserves the right to make any referral to the relevant authorities about any situation in violation of the terms and conditions, laws, regulations and / or corresponding guidelines identified by the conduct of any user.

  1. Use at your own risk

You expressly agree that you will use the Ticketera® service at your own risk. You are responsible for protecting the confidentiality of your password, if any, and for all activity that occurs under your account. If you learn or suspect that a third party is accessing your account without your authorization, you should immediately notify [email protected], [email protected], [email protected] or 787-305-3600.

  1. Service guarantee

The Ticketera® service is provided as is (“as is”), without express or implied warranties of any kind (including, without being and exhaustive list, warranties of title or implied warranties of merchantability or suitability for a particular purpose), other than those warranties implied or not subject to exclusion, restriction or modification under the laws applicable to this agreement.

TiX.By, its officers, directors, employees, shareholders, agents, content providers or licensors or licensors do not guarantee a service free from interruptions or errors. Nor do they guarantee the results that may be obtained from the use of the Ticketera® service, the acquisition of tickets or the precision, accuracy and correctness of any information, service or merchandise provided through the Ticketera® service.

  1. Disclaimer

This disclaimer applies to any damages caused by failure to perform, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, failure in communication lines, theft or destruction or unauthorized access, be it for breach of contract, tortious actions, negligence or any other cause of action. You specifically acknowledge that TiX.By and its agents are not responsible for defamatory, offensive, or illegal conduct of other users or third parties and that the risk of harm from the foregoing rests entirely with you.

  1. Limitation of liability and indemnity

Under no circumstances shall TiX.By, its agents or any other person or entity involved in the creation, production, sale, or distribution of tickets, be liable for any damages, including without being limited to any direct, indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use the Ticketera® service.

By using the Ticketera® service, you agree to defend, indemnify and hold harmless TiX.By, its affiliates and their respective directors, officers, shareholders, employees, agents and assigns from and against claims and expenses, including attorneys' fees, resulting from your use of the Ticketera® service.

  1. Equipment Use

You will be solely responsible for obtaining and maintaining all telephone, computer, tablet, and other equipment necessary to access and use , and for any and all charges related to its use.

  1. Copyright and trademarks

Ticketera® and other stylized versions of that name are trademarks of Tix.By LLC. All material subject to copyrights, trademarks and other proprietary information ("Intellectual Property") used as part of the Ticketera® service are the property of Ticketera® and their respective owners.

You may not modify, publish, transmit, participate in the transfer or sale, create derivative works from, or in any way take advantage of any part of this Intellectual Property. It is forbidden to upload, publish or otherwise make available on Ticketera® any material protected under copyright, trademark, or any other proprietary right without the express written consent of the owner of such rights. You will be solely responsible for any damages resulting from infringement of Intellectual Property rights, and expressly disclaim TiX.By liability for such damages.

  1. Ticketera® Content

Some of the content of Ticketera® is provided by third parties. Any opinions, advice, statements, services, offers or other information or content expressed or made available by users or third parties, including information providers, belong to their respective authors, owners, or distributors and not to TiX.By. Neither TiX.By nor its agents or any third party information provider guarantees the precision, accuracy or usefulness of the content or its commercialization or suitability for your particular use. TiX.By does not endorse and is not responsible for the accuracy or reliability of any opinion, advice or statement made on Ticketera® by anyone other than an employee or spokesperson of TiX.By while acting in its official capacity.

  1. Purchases in Puerto Rico

All purchases for events to be held in Puerto Rico will be completed through TiX.By LLC. Purchases for U.S. events not held in Puerto Rico will be completed through TiX.By USA LLC.

  1. Payment Methods

Several payment methods are accepted, including credit and debit cards. Only debit cards issued by banks located in Puerto Rico will be accepted. Payment methods for purchases made directly at the headquarters may include cash payment.

  1. Price and Availability

Ticketera® offers the ticketing service on behalf of event promoters, which means that we do not set ticket prices or determine seating locations or the duration of an event. The event promoter is responsible for determining the prices of your event tickets, the availability of your inventory and the duration of the content to be distributed by Ticketera® and Ticketera® LIVE.

  1. Charges

Tickets (and access to Ticketera® LIVE content) purchased through Ticketera® are subject to charges for services offered by Ticketera®. These may also include additional charges that are not established by Ticketera® and may not necessarily be optional. The price established on the ticket ("ticket") that gives you access to an in-person or online event represents the cost of admission and does not necessarily include all applicable service and processing fees. The charges for the services that Ticketera® offers when processing an order are non-refundable, even if the event is canceled or postponed since the services were provided when processing the purchase. In addition, there are additional charges that may vary by event or facility and are charges imposed by the promoter or facility; they are not charges imposed by Ticketera®.

Non-refundable charges are those for services provided at the time of purchase.

Also, as required, Ticketera® pays the IVU to the Department of Treasury once the service is provided.

  1. Taxes (IVU, applicable only in Puerto Rico)

Ticket prices, service charges and additional charges are subject to Sales and Use Tax ("IVU") and other additional taxes that are applicable within the jurisdiction of Puerto Rico.

  1. Ticket Delivery

If you choose to receive your tickets through the Print-at-home option, you can print it (s) and present it at the entrance of the venue where the event will take place. For tickets obtained through Email E-Ticket, simply show the ticket on your mobile device at the event entrance. Each buyer is responsible for preserving their ticket and preventing its mutilation and/or duplication.

Ticket sales in Puerto Rico are regulated through authorized ticket vendors. The purchase of ticket(s), or sales by a third party is not authorized. Ticketera® is not responsible for any matter related to unauthorized purchase and / or sales through third parties. Ticketera® reserves the right to invalidate any ticket made through unauthorized purchases in accordance with the terms and conditions, including tickets identified as tickets for resale and/or tickets in violation of user terms of use. Any ticket invalidated by Ticketera® in accordance with the terms and conditions may be placed again for sale through www.ticketera.com immediately. There will be no right to a refund and/or claim for tickets invalidated and/or cancelled by Ticketera® due to unauthorized resale situations.

Mutilation and/or alteration of tickets sold by Ticketera® is also prohibited. Any mutilation or alteration of the ticket entails the immediate cancellation and/or invalidation of the ticket, without the right to a refund and/or claim.

If duplicates of the same ticket are presented to an event, the venue may reserve the right to refuse entry to the holders of the tickets. If allowed, entry will only be honored to the person who purchased the ticket through the Ticketera® platform.

Ticketera® reserves the right to make any referral to the relevant authorities about any situation in violation of the terms and conditions, laws, regulations and/or guidelines identified of any invalidated transaction related to ticket resale, for the applicable fines.

  1. Internal rules and regulations of the premises

The ticket holder acknowledges all risks incidental to the event for which the ticket is being issued, whether they occurred before, during or after the event. Upon admission, the ticket holder agrees to comply with all laws, statutes, regulations, ordinances and rules applicable to the venue where the event will be held. Failure to comply with venue rules may result in your expulsion from the event. In accordance with its own internal rules and regulations, the management of the venue may reserve the right to refuse admission to any individual whose behavior appears to be questionable. Your expulsion from the event cancels the ticket and with that, the ticket holder informedly and voluntarily waives any claim for refund of the ticket price or any associated service or delivery charges. Children under 16 must be accompanied by an adult.

Lost, stolen or mutilated tickets will not be honored. In case duplicates of the ticket are presented, the venue reserves the right to refuse entry to ticket holders.

TiX.By is not responsible for any act carried out by the management of the premises towards the ticket holder and / or his companions.

  1. Returns and Exchanges

Every sale is final. No cancellations or changes are made to orders already processed. There are also no reprints of tickets already purchased, except in some circumstances as explained in the section below.

  1. Cancellations and Postponements of events of public shows and Ticketera® LIVE

Cancellations of events that take place in Puerto Rico are regulated by the Office of Services to the Promoter of Public Shows of the Department of Treasury of Puerto Rico (only in Puerto Rico). The date, time and location of the event may be subject to change. If any of the aforementioned changes arise, it will be the responsibility of the promoter to manage the refund of the ticket price and the tax applicable to the ticket price.

If an event is cancelled or postponed, the event promoter communicates the changes and instructions on reimbursement through some means of communication, including sending a communication to the email used for the purchase of tickets to the event. If the event is cancelled the buyer will have 30 days to submit a refund claim. In case of change of date, time or place of the event, the buyer will receive a communication to the email indicating the instructions on the refund, including deadline established only by the promoter of the event.

Ticketera® service and/or processing charges are non-refundable. For Ticketera® LIVE events, there will be no refund due to lack of access and / or difficulties in accessing internet connection and / or electricity.

  1. Copyright for Ticketera® LIVE events

The copyright on the images and video belongs to the owners thereof. In compliance with the copyright of their holders, the links to access the events through the system of "streaming" live, "Pay Per View" or "On Demand" cannot be shared or resold to third parties.

The material accessed through the Ticketera® LIVE service is for residential use only. Commercial use of Ticketera® LIVE broadcasts in public places is not permitted. The content distributed and/or exhibited by Ticketera® LIVE may not be accessed or viewed in commercial places such as bars, restaurants, hotels, or public places. Neither the online content nor the presentations distributed by Ticketera® LIVE may be reproduced, duplicated, copied, visited, saved, retransmitted in any form or electronic or mechanical means, sold, resold, or exploited in any way. The client may not, for any reason, alter, edit, supplement, omit or circumvent any element received as part of the Ticketera® LIVE service, including the insertion of trackers or advertisements immediately before, during or after the exhibition or transmission of the program.

  1. Limitation of liability Ticketera® LIVE events

The material produced through our site is produced in Good faith for the general audience. The material distributed through "live streaming", "On Demand," y/o "Pay Per View" belong to third parties with whom TIX.BY only has contracted the rights to distribute the content. The content of the transmissions is the Property of third parties who hold and represent to have the intellectual property rights of everything contained in the transmissions. We are not responsible for any loss, damage or expenses incurred as a result of any circumstance or expression made through our page or the Ticketera® LIVE transmissions. We do our best to keep the page as up-to-date as possible, but in view of the nature of constant changes we are not responsible for the accuracy of the information contained and the opinions that may be expressed on our page.

  1. Access and system requirements for Ticketera® LIVE events

We will do our best to ensure that the availability of content on our site is not interrupted and that transmissions are error-free. However, due to the nature of the internet, this cannot be guaranteed. The user is recommended to have a device with a system capable of receiving transmission of high-resolution audiovisual content for online events (streaming). Ticketera® is not responsible for any decrease in quality of the event by using any system with lower requirements and / or capacities.

In the case of "live streaming" and / or "Pay Per View", the client will be responsible for being connected from the beginning of the "live streaming" since he will not be able to go back once the transmission has begun, and at the end of the event access to the content will cease. Only one customer device will be given access to the content; If access requests are identified under the same link, only the first access that is identified and connected to the transmission will be honored.

In the case of "On Demand", the customer will have 24 hours from completing the purchase transaction to access the content. The client will be able to access the content as many times as they wants within 24 hours. Only one customer device will be given access to the content; If access requests are identified under the same link, only the first access that is identified and connected to the transmission will be honored.

  1. Links to Other Third Party Sites and Offers

Ticketera® is not responsible for the content of third-party pages promoted on its page, nor for expenses or damages incurred as a result of these. Ticketera® is not responsible or provides any guarantee about product availability, prices, shipping, satisfaction, or any other matter related to products and / or services that are promoted through third party links. We suggest reviewing the terms and conditions of these third party links and their business practices before entering into any transactions with them.

  1. Discount for Seniors and People with Disabilities 65 and older (Puerto Rico only)

A minimum of 5% of the total tickets on sale for each performance will be reserved for people 65 years and older at a discount of 50% off the regular ticket price. This discount will be available up to 72 hours before the event and only applies to the regular ticket price, not to service charges or other additional charges established by Ticketera®. To apply this discount, it is required to make the purchase in person presenting a valid and current identification, with photo and date of birth, issued by the Commonwealth of Puerto Rico. The Senior person will be required to be present at the entrance of the event and must present their photo identification to gain entry to the event. This discount will only be valid for events that take place in a location that belongs to or is operated by the Commonwealth of Puerto Rico.

  1. Discount for people with disabilities

A discount of 50% of the regular ticket price will be applied to people with disabilities. This discount only applies to the regular price of the ticket and not to the service charges or other additional charges established by Ticketera®. To apply this discount, it is required to make the purchase presenting the card issued by the Department of Health of Puerto Rico that certifies the impairment. It is required that the person with a disability will be required to be present at the entrance of the event and must present photo identification to gain entry to the event. This discount will only be valid for events that take place in a location that belongs to or is operated by the Commonwealth of Puerto Rico.

Both the discount for people over 65 years of age and for people with disabilities will only be valid for events that take place in a location that belongs to or is operated by the Commonwealth of Puerto Rico. Both discounts are subject to applicable laws and regulations.

  1. COVID-19 Warning:

There is an inherent risk of exposure to COVID-19 anywhere people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By attending an event, you assume all risks and hazards arising out of or relating in any way to the risk of contracting a communicable disease or ailment, including, but not limited to, exposure to COVID-19 or any other bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether exposure occurs earlier, during or after the event, and regardless of how caused or contracted, and you hereby waive any and all potential claims and claims against TiX.By, Ticketera® and the Event Organizer and against any company affiliated with TiX.By, Ticketera® or the Event Organizer, in relation to such risks and dangers.

  1. Entire Agreement

The user/holder of tickets obtained through the Ticketera® service is responsible for reading and complying with these Terms and Conditions, as well as any policies, rules and/or terms and conditions established by the promoters of the event and the owners of the facilities where the event will take place.

  1. Applicable Laws

These Terms and Conditions shall be construed in accordance with the laws of the Commonwealth of Puerto Rico. Any cause of action of any nature arising under these Terms and Conditions shall be instituted in the Commonwealth of Puerto Rico.

  1. Dispute Resolution

These Terms and Conditions shall be governed by and construed under the laws of the Commonwealth of Puerto Rico. Any claim or dispute arising out of the services subject to these Terms and Conditions shall be submitted to arbitration before the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a neutral arbitrator chosen by agreement between the parties and shall be in accordance with the Puerto Rico Arbitration Act (32 L.P.R.A. §3201) and supplemented by the Federal Arbitration Act (Title 9 of the United States Code).

If the claim is less than fifteen thousand dollars ($15,000.00) either party will have the option, but not the obligation, to file the claim in the courts of Puerto Rico pursuant to Rule 60 of the Puerto Rico Civil Procedure Rule (32 L.P.R.A. Ap. V R. §60) prior to commencing an arbitration proceeding, pursuant to Rule 9 of the Consumer Arbitration Rules of the American Arbitration Association.

  1. Claims about ticket sales for Events parking

In case of postponement or cancellation of an Event, the process will be subject to Ticketera's ticket return policy. Receipts on event parking tickets will have a breakdown of prices and any other applicable payments. Any other claims related to tickets for parking the Event should be directed to the parking operator. The operator is identified on the Event parking ticket.

  1. Invalidated transactions

Ticketera shall have the right to cancel user accounts and invalidate transactions that are made in violation of Ticketera®'s terms and conditions. Ticketera® may invalidate transactions that show purchases in excess of the limits per user allowed for the event and/or that Ticketera® understands that, in its sole discretion, have been made through manipulation of systems including, but not limited to, transactions through the use of "bots", non-human automated methods, and/or that the use of the same debit and/or credit cards is identified for multiple transactions. In the event that a transaction is invalidated, the buyer will be notified and the tickets, if already sent, will be null and void. Amounts paid for invalidated transactions will be refunded to the same payment method used by the user. Separate tickets for invalidated transactions will automatically be placed for sale by the system in www.ticketera.com.

Ticketera® reserves the right to make any referral to the relevant authorities about any situation in violation of the terms and conditions, laws, regulations and/or relevant guidelines identified from any invalidated transaction.
